Law and Language
One can`t deny that the interplay between our daily lives and law is pivotal to our existence. Even when we are breathing, Article 21 of our constitution protects us. When we buy some product from a shop, taxes imposed under various laws play a role in determining the cost of that product. These are just few of the various examples that we encounter in our daily life which exhibit the role of law in our everyday lives. But to know what the law is and to understand it, so that we can act accordingly, one needs to have some command over the language. Even in common law countries where we witness unwritten laws, precedents have cardinal place. And to use those precedents appropriately we need to understand the judgments. Also, judges need to use the right words at the right time to convey the real purpose of the precedent. Law and language are inter-related for even language operates on certain laws. We have various rules and laws of grammar, which if broken, would take away the essence of the language. I always had a few questions regarding this topic lingering in my mind. Why is legal language so complicated? How do lawyers twist it according to their advantage? How easy judges find it to interpret the legal jargon? Is there even a need for legalese? How has the language, the law is written in, affected the awareness among people? There are more questions that I await an answer for and this project has given me a great opportunity to look for those answers THE INTERVIEW For the same purpose I interviewed Sri V. Srinivasa Sivaram, Administrative Officer, Andhra Pradesh State Legal Services Authority. ââ¬Å"The National Legal Services Authority (NALSA) has been constituted under the Legal Services Authorities Act, 1987 to provide free Legal Services to the weaker sections of the society and to organize Lok Adalats for amicable settlement of disputes. In every State, State Legal Services Authority has been constituted to give effect to the policies and directions of the NALSA and to give free legal services to the people and conduct Lok Adalats in the State.. â⬠With his experience and connect to the local people, I felt he would be able to answers my questions. I thank him for giving his valuable time for me. Here is an excerpt of the interview Q. Sir, you are associated with Andhra Pradesh Legal Services Authority, and many financially distressed people who canââ¬â¢t afford a lawyer approach you for help. What level of legal awareness do you find amongst these people about their rights and duties especially when the laws and statutes are written in English? A. Since I`m working with the legal service authority for past some time, one thing that I find is that people donââ¬â¢t come to us because they have some right or a duty. They come to us because they have a problem. It may be related to law or may not be related to law. 90% of the times, we have to find out what the law is with respect to their problem. The people approaching us are not aware if a law can help them and if so, which law. They are aware that if they have a problem and they are approaching legal service authority, then we will help them. Many a times I have spoken to people and asked them ââ¬Å"How did you come to know of legal service? â⬠The most common reply is sir, we have been told or we heard it on TV or Radio. After they approach us, we have to find the remedy for them and most importantly look if that remedy is within the four corners of law. They are not aware of the law in that respect. They just have a problem in hand and they come to us, looking for remedy, and asking whether law can help them or not. Q. For many disputes, the local people first approach the district court and then may appeal in higher courts. Do the district courts work in the local language or in English? What is your opinion regarding this. A. With respect to this question, I would like to tell you that both local languages and English are used. If a person is illiterate or he doesnââ¬â¢t understand English well, especially when you have to conduct a trial, when you ask during chief examination or during cross examination, the local language is the best thing Q. Do the courts give the judgment i. e. s the written judgment in regional language or is the usage of regional language restricted for oral purposes only? A. For the time being, it is totally in English. But the judges are not stopped from using the regional language. For example, one of friends has given a couple of judgments in Telugu also. But doing so is very difficult. The hindrances that they encounter are numerous. When they have to rewrite a c ase law or quote a case from Supreme Court it becomes virtually very difficult to quote it in Telugu.. We also have latin maxims that would be adding to this difficulty. You are right. We cannot quote them in regional language. We may not pass on the meaning properly. If you quote Evidence Act in Hindi or Telugu, I tell you, it will be a nightmare! Although we are very proficient in Hindi and Telugu, on trying to do so, we couldnââ¬â¢t succeed. Try converting a judgment by Hon`ble Judge Krishna Iyer into your local language or Telugu, it will be a disaster! Even people who are conversant in English find it difficult to understand his judgment. The language is highly complex, full with rhetoric. Many Supreme Court judgments are in such a way that a common man can`t understand it. This also applies to people who are well familiar with English. Until and unless one doesnââ¬â¢t have the knowledge of the legal jargon used, they can`t comprehend it. Q. The laws are basically for the people. But with the complicated language they are written in, a person finds it very difficult to read through them. Do you think there is a need to simplify legal language? A. It is high time that the legal language is simplified. One thing that we see is, for a simple word example may or shall, battles are fought in court. The Supreme Court may end up saying ââ¬Ëmayââ¬â¢ is not ââ¬Ëmayââ¬â¢, it is ââ¬Ëshallââ¬â¢ and ââ¬Ëshallââ¬â¢ is ââ¬Ëmayââ¬â¢! Because the interpretation of such basic words takes place in different ways, a common man can`t understand it. Yes Sir, I do remember a case ââ¬ËState Of Madhya Pradesh vs Azad Bharat Finance Coââ¬â¢. Here under an Act, although the District court interpreted the use of word ââ¬Ëshallââ¬â¢ as obligatory, the Supreme Court interpreted it as ââ¬Å" The word ââ¬Ëshall' is not always mandatory; it depends upon the context in which the word occurs and the other circumstances. â⬠Yes. We have many other examples. Few years back when a question arose if a written statement has to be filed within 90 days of the amended CPC, it was said that NO although the word used is shall. If this is the fate of the people who know law, then imagine the plight of the common man. Q. I agree with you sir. But if the legal language is simplified, doesnââ¬â¢t it leaves some loopholes that maybe misused by many? A. Look, even now it is happening. You write one line and the lawyers are bound to pick up loop holes in that one line also. This is so, because we have been taught to do that! Every lawyer tries to use the words according to his own convenience and the benefit of his client. Q. What approach do you adopt while interpretation of any law. Is it a positivist approach strictly based on the language and the words used or you try to look into the history and spirit of the law? A. I prefer to go by the spirit of the law. We donââ¬â¢t have access to the constitutional debates. In lower courts, when we have to go about finding what is the meaning and the spirit of the law, unless you see the original framework of the law, you donââ¬â¢t know why it was written. I do remember the case of ââ¬ËBaljeet Singh vs Election Commission Of India And .. ââ¬â¢ Here the petitioner argued that a member of parliament takes an oath to ââ¬Ëmake and subscribeââ¬â¢ to the constitution of India. Hence the interpretation is that each and every legislator must be literate to understand the India`s constitution. The Supreme Court referred back to the constitutional assembly debate and concluded that literacy was never meant to be an extra qualification to be a member of parliament. The purpose behind such an oath was to promote national unity and not to make literacy a pre-requisite condition. Yes. Sometimes if you donââ¬â¢t know the intention behind a law, you can`t come to any particular conclusion about its meaning. If you have access, well and good but many lower courts donââ¬â¢t have access to constitutional debates. An Act or statute may give you two or three lines about its purpose, but if you want to go further you donââ¬â¢t have access to that thing. So, if there is a conflict you will interpret it in a manner as you feel proper. But certain situations demand interpretation using the strict language rule. This has been played by the higher courts in many ways! And since we say that Supreme Court judgment is the law of the land, we are bound to end up in confusion. Let me put forth one example. A question arose whether a company can be prosecuted or not for criminal actions. The punishment prescribed includes both fine and imprisonment. One interpretation was that since a company is not a real person and you can`t throw it in jail, hence only a fine will be imposed. But the Supreme Court said that since you can`t put the company in jail, you can`t inflict the punishment prescribed in the act, hence the ntire proceeding were quashed. Subsequently, after few months another judgment came, in which another company, I`m not sure but maybe Standard Chartered Bank, relying on the earlier judgment, pleaded for the quashing of the procedures. But this time, it was held that although we can`t put you in jail; you are liable to pay the fine. Another important issue is the way a common man interprets a law is very different. Let me put to you an exampl e I came across. In rural areas, when I spoke to some people, they are aware that there is a law that deals with harassment. But for them, harassment is any kind of harassment. A woman claimed since her husband drinks and doesnââ¬â¢t contribute much for the family, he is harassing me. Technically, you can`t stop a person from drinking. They hold very different perception of the same law. Some lawyers take them for a ride. When such women approach them, they suggest filling a suit under sec498 which deals with dowry harassment! This obviously leads to exploitation as they mint money in spite of knowing that no remedy lies in law. Q. Sir, this situation is dangerous. People may develop wrong perceptions that law can`t help them and may lose faith in the system. Doesnââ¬â¢t it demand spreading awareness among people. A. You are right. We do take measures to spread some awareness. For example, we have a regular programme on etv in which a judge tries to answer the queries of the people and explain the remedy to them. I came across a group of LGBT. Although they came from a village, they were well aware about sec 377 and were speaking on how it is unconstitutional. Then they told me how a sensitization programme was carried out by an NGO in Telugu. So, laws arenââ¬â¢t that difficult to understand, if explained properly Q,CLAT[common law admission test] for admission to the National Law schools is conducted in English. Do you think, the exam should be conducted in other regional languages to increase diversity and access? A. You should answer this question better!. Well the entire situation can be summed up in one or two lines. Whether the legal education should be in local language or English? No doubt, the language may act as a barrier. But in a country having about 28 states with different languages, if the Supreme Court has to read from Gujurati to Malayalam, then it would be a nightmare for everybody. The statutes and legislations are in English. An exact translation in any other language is not possible. The exact meaning may be lost. We can`t avoid English. Now, we have got used to a procedure where we use both regional language and English. The legislations are in English, debates, judgments all are in English. As I said, we can`t have literal translation of each and every word. Thus, my point is legal education has to take place in English. But at the same time, I donââ¬â¢t deny that regional language would prove to be beneficial, but practically, you need legal education in English medium. Q. Finally, how do you as a judge, view the connection between law and language? Do you think the efficiency of a judge or advocate would be affected due to lack of knowledge in a particular language? A. I have come across many people who can put forth extremely strong arguments in regional language. But they would have become better lawyers had they been proficient in English. But you will see, many a times being good in English won`t help you if you donââ¬â¢t have a command over the regional language too. When a client approaches with any problem, you should be able enough to connect with them, so that they can openly discuss the issues at hand with them. You can explain the law to them in their language so that they understand better and discuss the appropriate remedy. Many a times, if you want to cross-examine a witness you need to do that in his local language. If the poor guy is not well versed in English, then he may say something with some different meaning, which obviously you see would land him in trouble. Now-a-days we have technological tools in the Internet that help us to translate. That day I wanted to read an article on mediation which was in a language, I wasnââ¬â¢t familiar with. This translation tool helped me to translate it in English and the contents too were satisfactory. So in the contemporary times, with internet you can remove a lot of disadvantages. CONCLUSION The interview was a interesting one for it helped me broaden my horizons on the general public conceptions of law. Sri V. Srinivasa Sivaram rightly pointed out to me the problems that plagued the system, which never came to my notice before. But since this project is about the relation of law and language, I would like to narrow down on that issue. Most of his answers were convincing. English can`t be entirely avoided. With the diversity in languages that we have, what a statute may mean in one language, would mean something else in the other as literal translation is not possible every time. But this doesnââ¬â¢t mean neglecting regional languages. They need to work side-by-side which evidently is witnessed esp. in the working of lower courts. This is so because it is obviously beneficial for public good. All Laws are made for a reason and purpose. They sometimes seek to repair a defect prevalent in the system. So, the courts should move beyond the interplay of words. Legal jargon or legalese needs to be simplified. I would like to quote Mr. Sivaram on this issue. He aptly illustrates why legalese should be restricted. ââ¬Å"One maybe proficient in English, but if they are told to read Physics or Chemistry, then they wont be able to. Law is for the people. It governs and regulates the action and life of the people. Thus, it should be in a way that people can ordinarily understand.

It is very important that an organization as Pepsi considers Russia environment before beginning re-organization. In fact, environmental analysis should be continuous and treat all aspects of planning. One of marketing tools that often uses to analyze environmental economic is PEST including political factors, economic factors, social factors, and technological factors. Political factor; According to beginning of year 1992 in Russia, the politics at that time is concerned to be communist before changing to democracy in May 1992. Business needs to consider the state of economy in short and long terms, and economic factors are the important tool for international marketing. In Russia, the economics seems to be capitalism, and a free market, but in fact people still stick to the communist system, so that the free looks unreal. There is less competition on market due to government regulation and control system. The economic environment has the unappreciated sign. The workers are inefficient, the organization presents overstaffing and nepotism, and the system also identifies as nepotism. The people are employed as presenting high employment rate, but they work with low efficiency and effectiveness. One problem why Pepsi cannot rapidly grow in Russia is language and cultural barriers. The culture is traditional. There are not many people who have English knowledge. Moreover, confidential issue should be careful because everyone alks and share information to each other in their society. The other interesting point is that Russians are not get use to western style resulting to difficulty of working in western company. Russian system is flexible and no specific rule in some topics; for example businesses cannot get reference checks for their employments. Because of social factors, Russians are less interest in foreign business even tho ugh there are many western companies in Russia, so that it creates the difficult work for HR department when they want to hire efficient labor. Technology factor; Technology is competitive advantage for international business. In Russia, there are fewer technologies to allow customers to easily access to products. All technologies base on the local resources. However, Pepsi use the technology to be the media of their advertising, such as television, and newspaper. Pepsi also adds the technology such as vending machine in their selling instead of using middle man or personal selling. Even though Pepsi want to use the high effective technology, it is useless because the distribution is state-owned and controlled. Analyze Pepsi as a company. In term of marketing process, there are many interesting key points which contribute its performance. 1. Research: Pepsi tries to build the Russian organization. Bill Shaddy is the company representative to do the research and analyze situation including culture, politics, resource and technology, social environment, demography, business, and human behavior. Even though there is another competition as coke that dominates the soft drink market in Russia, Pepsi wants to expand its market, and it is talent for Pepsi. 2. Target customer: all genders and ages are the target customers. The middle class is the main target of company that we can see example in India. There are several criteria to analyze its performance which are: * Defendable: it is competitive in its market because it preserves a great quality because Pepsi technicians trained the partners on quality control, and good service in store and out store. Moreover, it has loyal customers in America that can prove by marketing share. There is only one big company as Coca cola that produces the same product. Accessible: Pepsi is dispensed out of sidewalk fountain machines, and distribution to many retailers. * Expandable: there is an opportunity for selling its products, since there is high demand. Pepsi has a lot of franchises, and also creates the new taste for their products; for example, a lemon-flavored soft drink in the Soviet market. * Serviceable: generally, Pepsi relies on shelf space and positioning, as well as convenience packaging and provides the good service for all customers, but in Russian stores do not compete on service. Profitable: it is profitable because Pepsi has a lot of customers and the cost cut in building like the situation in Russia that Shaddy tries to find the cheapest office. Product: Good quality soft drink, and convenient package. * Promotion: Pepsi uses various channels to promote its product, such as news paper, television commercial, outdoor, kiosk displays, sponsored promotion, and events. * Place: Providing in everywhere, especially in American market. 5. Execute: to penetrate the existing market by using many promotion, keeping quality, and developing products. From the above points that make Pepsi achieves its success goal, we can conclude that the Pepsi marketing strategies meet the need of its customers. This situation can be called as touch point. Moreover, Pepsi also uses push and pull of marketing strategy. It advertises in public. This can be called as creating a demand strategy. When people hear or receive information about it, they go to get the product. Moreover, word of mouth is another channel of advertising which is useful for Pepsi. Recommendation; As we can see that Pepsi gains market share leadership in U. S. food store sales, but in most European and Asian markets where Coke has higher market share than Pepsi. Therefore, researching in all factors, and developing in those markets should be considered in order to be leadership in soft drink market. In Russia, 1992, there are many problems issued, such as politics, economic system, social factors, technology; all we know as PEST. There are some suitable ways to solve those problems as below, Political factor : The politics still bases on communist even it changed to democracy system. The polictics influences in business. Pepsi should slow down in its investment due to adjusting period of Russian government. Economic factor: Considering in international financial institution due to unstable economics in Russia during this period. Social factor: Education is the key factor to develop the system. Creating the organize culture to all Pepsiââ¬â¢s employees to make them to be proud in organization. Training is required to improve productivity. Using reward or bonus motivates employees to increase efficiency. Technology factor: Using more technologies offer consumer and business more innovative products and services. The company should hire the specialists to develop programs which support marketing plan, and Human Resource Management. Customer Relationship Management (CRM) should apply. The specific questions asked by Bill Shaddy; According to the last paragraph, the writer mentions on the Bill Shaddy question that ââ¬Å"How to go about finding Russians that could become successful ââ¬Å"Pepsiâ⬠people. How would he select them? And how should they be compensated, trained and managed? In my point of view, those questions are related to human resource management on recruitment and selection process. Shaddy has to consider all factors about Russia, especially social issue such as culture, education, demographics, and then all components should be included into the recruitment process and selection process in order to get the right person to the right job effectively. The first job is to identify the job opening as a Sales Manager and a Technical Engineering Manager through HR planning based on organizational values and code of conduct. Next step is to delicately determine the job description and job specification. This process should be clear and easy to understand. If lacking of candidate-qualificationââ¬â¢s detail, it is difficult to find the right person due to under qualified applicants. Both a Sales Manager and a Technical Engineering Manager position are in management level; thus the minimum experience should be significant important qualify to handle the jobs. The other important part of recruitment is that recruiting sources and methods are chosen. There is no single, best recruiting technique, and the most appropriate for any given position depends on a number of factors. In this case, Russia is considered to be the communism, old fashion, and technology is not widely used, so that Shaddy should invest online recruitment in low proportion of recruitment cost. The method should be considered such as government employment agencies, searching through direct networking from foreign company, and print advertising. The reasons why government employment agencies should be used because Russia government plays high role in every activity of Russians. Another reason is talking with local people might make Russians more comfortable, confidence, and feel more reliable. They will not want to work for western companies because of development aspect; therefore, using government representative to find the effective people should be concerned. The benefit from using foreign company network is that company can be confident the knowledge and language ability of people who are hired. However, some situation might happen when Shaddy find the right people, but they are working for other companies. In this case, Pepsi should consider investing more money to motivate them to come to be the part of organization. There is another way is printing advertising. This way is the lowest investment, but getting high result. Pepsi has many retailer, outdoor events, and kiosks in Russia. Shaddy should use these channels to post a job advertisement. Many Russian might interest in job advertisement, and directly come to Shaddy. After finishing recruitment, a pool of qualified recruits is generated. Then, Shaddy should go to the step of selection. First, the people not meeting the essential selection criteria are eliminated first. The remaining are examined and those of them who most closely match the job specifications are identified and consideration. The job positions however require the experience to handle the job. The situation is that there are few Russians with relevant business experience, thus the intensive training program such as oversea training should be provided to them. Second, the test should be used for finding the appropriate Russians by testing ability, emotional intelligence, and specific thinking skill. The world-wide values of organization should be included in the test. For example, challenging assumptions to generate new ideas and approaches by situation testing. Next, the most important part of selection before hiring decision is the selection interview. Given people, who are selected, higher valid in prediction job performance, the focus should be on situational and behavioral questions. Shaddy should consider both their aspects and actions when they respond the questions. If Shaddy pays attention to all steps of recruitment and selection, Pepsi will get the efficient people to do the jobs. However, when getting the right people, how they should be compensated, trained and managed. The simple idea is that providing effective training programs in term of practice and theory, and these programs have to be analyzed and evaluated. The foreign assignment in the countries, in which PepsiCo succeeded, is helpful for new managers. There is the need to manage with a workforce and management colleagues whose cultural factors may be dramatically different from their own, and the considerable stress in foreign land can bring to bear on manager position, but they can learn other things from effective organizations in foreign countries so as to apply to use in Russia. The experience is also helping new managers to solve the problems which might be occurred during working. If Shaddy carefully consider in all above issues, he will hire the proficient Russians to become successful ââ¬Å"Pepsiâ⬠people, and significantly contributes to be successful. Zagu Co. Background I. We would like to make a study regarding the process of making a shake in one of the famous shake store in the Metro ââ¬â Zagu. Standard time data are element time standards, from time studies, that have been proven to be accurate and reliable. Analysts classify and file element standards so they can be readily abstracted when needed. The application of standard time data is fundamentally an extension of the same process used to arrive at allowed times through a stopwatch time study. Standard data can have several levels of refinement: motion, element, and task. The more refined the standard data element, the roader the range of usage. Standard Data are compiled from different elements in time studies of a given process over a period of time. Time Study is a technique for establishing an allowed time standard for performing a given task. This technique is based on measuring the work content of the prescribed method.

It is the grace of God, due to which He has given us humans the unearned favor of eternal salvation by sending his Son to earth and dying on a cross for our sins. Baptists a lso believe that the world will end, and Jesus would return to us and the dead will be raised and everyone be judged by Him. Finally, we believe that the Message of God needs to be spread throughout the world, so that more people can be brought within the fold and experience the Grace of God. I know that my beliefs are true, because the Bible speaks out to me. I have personally experienced the grace and miracles of Jesus Christ in my life. When a very close cousin of mine was diagnosed with cancer, and it was clear that the cancer had spread throughout her body, the doctors told her that there was no treatment available for her, and the best all of us could do was to keep her comfortable at home. I turned to Jesus Christ in my time of need and He spoke out to me and answered my prayers through a miracle: my cousin not only survived, but her cancer is in complete remission. My worldview is accurate because it is clear by looking around that God exists, also, He is just and kind and i t was told in the Bible many years ago. What is more, the Bible is a direct account of what God wanted people to do, and its message is still true today. Even after 2,000 years, we can still derive our morality from the Bible and that is clear proof of its Divine Origins. It is very clear when one observes these facts that my worldview is accurate and believable. Part 2 Just like Baptists, Catholics are a denomination of Christians who believe in the unity of the God and the Holy Trinity. There are many more similarities between the two groups. The Catholics also believe in the virgin birth of Jesus Christ. Like the Baptists, the Catholics believe in the miracles of Jesus Christ, including healing the leper and raising Lazarus; his crucifixion and subsequent death; his burial; and his resurrection after three days. Moreover, they also believe in the infinite Mercy and Grace of God, which God showed by sending his only son to die for humans for their salvation. There are many similar ities in the ethics of the two groups as well; there is an emphasis on moral uprightness in both the groups, but, both believe, that there is no salvation for us except through Jesus Christ and his sacrifice for us. There are, however, many differences between the two, I will mention two big differences here. Firstly, there is no central authority for Baptists. Unlike the Catholics who have the papacy, whereby a group of priests elect a Pope, the Bishop of Rome, who is the considered to be a successor of Saint Peter, the Baptists do not have a central authority that ensures that beliefs are kept identical throughout the various Churches of the denomination. The main areas of research were: history of the company, social media impact, strategic issues and opportunities. The focus was on the most recent news and events that affected the company as well as the entire industry. Company Information Heineken N. V. was founded in 1873 in Netherlands and has become the worldââ¬â¢s most international brewer (Heineken, 2013). It operates in Western Europe, Central and Eastern Europe, Africa and the Middle East, The Americas, and Asia Pacific. The company is keen on contributing to a sustainable future. Their strategy is based on the four focus areas: conserving water, decreasing CO2 emissions, responsible agriculture, and responsible consumption. Heineken also believes that innovation is key to future success. The Heineken Ignite beer bottle is their new invention. The brewing industry has a lot of room for improvement and growth. The improvement must begin from changing the consumersââ¬â¢ perspective about beer in order to create a lasting relationship. An ongoing education about beer and beer consumption is also something that can change consumersââ¬â¢ perceptions and preferences. In order to stay competitive, one must ââ¬Å"bring differentiation while still retaining a recognizable and familiar aspectâ⬠(t). Social Media is a powerful tool that must be utilized in order to reach consumers as well as to learn about consumer behavior and generate feedback. Study Limitations and Directions for Future Research I found the most credible sources were the companyââ¬â¢s websites, Business and Company Resoucre Centre and Global Market Information Database (GMID). The least credible was Wikipedia (was not included in this research paper) since some of the information was not accurate and up do date. Canadian Business and Current Affairs, I found to be the least up to date and least helpful. There is much more research that could be conducted in regards to this topic- alcohol regulation, exporting tariffs, cross marketing strategies, etc. The above research should be used as a foundation for the in depth analysis of the brewing industry of Canada.

The Courthouse Hotel is a large, privately owned establishment located in the centre of a large city. Once the major hotel in the city, it has in recent years struggled to maintain profit margins in the face of competition from three new hotels operated by well-known national and international chains. The Courthouse maintains a three-star standard of service, competing primarily on the basis of cost. Its prices are therefore kept considerably lower than those charged in the newer hotels, while the range and quality of food and accommodation are also of a lower standard. The hotel has 150 bedrooms, a bar, a carvery style restaurant, and a function room which is used for private dinners and business meetings. There are no large-scale banqueting facilities, no porters and no room service. While there are one or two part-time members of staff, 95% are employed on full-time permanent contracts. With the exception of a few senior managers, administrators and night workers, the staff work either early or late shifts (ie 6.30-3.30 or 3.00-11.00). Because the vast majority of the hotels guests are business people staying on week-nights, staff are required to work only one weekend in every four. Three months ago a well-known businessman purchased the hotel with a number of interests in the city. He has decided to change the business strategy by moving the hotel up-market to a four star standard and offering a wider range of services. A major refurbishment is planned, together with the opening of a new banqueting suite, an à la carte restaurant, a leisure club, a full portering service and extensive lounge / room service operation. In staffing terms there is a need to improve the interpersonal skills of staff and to raise general standards of customer service by a substantial margin. The rationale for these developments is the impending opening of a new convention center a short walk away from the hotel. From January next year it is expected that the volume of trade will increase by 60 per cent, provided the Courthouse can raise its standards to those expected of a wealthier and more international clientele. The problem, from a people management perspective, is the likely erratic nature of business patterns once the convention centre opens. Periods of several weeks will go by with relatively little occurring in the centre, punctuated by shorter periods of frenetic activity when major conferences, exhibitions, concerts and sporting events take place. A more specific opportunity presents itself next summer, when as part of a bid to publicise the citys new convention centre, the government has announced that it will be hosting a major intergovernmental conference in the city. For the duration of this event each hotel will house a particular delegation, with the Courthouse being allocated to the Germans. This means that the entire hotel will be taken over by the German Chancellor, other senior German politicians, advisers, civil servants and 75 accredited journalists for a week next summer. During that period there will be a heavy security operation in the hotel. It will also have to host several press conferences and a series of breakfast meetings at which the Chancellor will meet other world leaders. In addition, it will have to maintain a far higher standard of cuisine and service than it is accustomed to providing. If successful, a large amount of positive publicity can be guaranteed. If, on the other hand, the hotel conspicuous ly fails to provide the standard of service expected by a Government delegation, the ensuing negative publicity way will undermine the whole refurbishment strategy planned by the new owner.
